Kullan\u0131lan \u00f6zg\u00fcrl\u00fckler ve toplumsal geli\u015fmeler de facto\u00a0 bi\u00e7imde yasalar\u0131n \u00f6n\u00fcne ge\u00e7mektedir. Kurulu d\u00fczen ve mevcut anayasa;<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">&#8211; B\u00fct\u00fcn bir toplumu tepeden t\u0131rna\u011fa de\u011fi\u015ftirmeye \u00e7abalayan totaliter ve otoriter karakteriyle,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">&#8211; \u0130nsan haklar\u0131, az\u0131nl\u0131k haklar\u0131 ve g\u00fcvenlik gibi en temel g\u00f6revleri bile ger\u00e7ekle\u015ftiremeyen ayg\u0131tlar\u0131yla,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">&#8211; Devleti kuran asli unsurlara yakla\u015f\u0131mda oldu\u011fu gibi vatanda\u015flar\u0131na y\u00f6nelik bireysel hak d\u00fczenlemelerinde makul bir adalet teorisi tesis edemeyen hukuk sistemiyle,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">&#8211;\u00a0 Resmi ideoloji empoze etme \u00f6zelli\u011fiyle,\u00a0 <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">&#8211; Hak taleplerine uygun bi\u00e7imde toplumsal gruplar aras\u0131nda payla\u015ft\u0131r\u0131lamam\u0131\u015f egemenlik anlay\u0131\u015f\u0131yla, sorunlar\u0131n ana kayna\u011f\u0131 olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. <\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">1982 anayasas\u0131 ruhu bak\u0131m\u0131ndan militarist, devlet\u00e7i, ideolojik, \u00fcniter oldu\u011fundan sosyolojik dinamiklerin ortaya \u00e7\u0131kard\u0131\u011f\u0131 siyasal \u00f6rg\u00fctlenmelerin hemen t\u00fcm\u00fcne kar\u015f\u0131d\u0131r. Bu durum \u00f6zg\u00fcrl\u00fcklerin geni\u015fletilmesine engel te\u015fkil etmektedir. Y\u00f6netme iddias\u0131 ta\u015f\u0131d\u0131\u011f\u0131 halklar\u0131n ve s\u0131n\u0131flar\u0131n de\u011ferleriyle kavga etmeyip varl\u0131klar\u0131n\u0131 koruma alt\u0131na alan ve insan haklar\u0131 perspektifiyle haz\u0131rlanm\u0131\u015f yeni bir anayasaya bu y\u00fczden ihtiya\u00e7 vard\u0131r. Yeni anayasa toplumsal uzla\u015fma ve kal\u0131c\u0131 adil bir d\u00fczenin t\u00fcm ayg\u0131tlar\u0131yla ortaya \u00e7\u0131kmas\u0131n\u0131 sa\u011flamak i\u00e7in eski anayasadaki ideolojik feti\u015fizmden, de\u011fi\u015ftirilemez maddelerden ve dolay\u0131s\u0131yla Atat\u00fcrk milliyet\u00e7ili\u011fi gibi ideolojik arg\u00fcmantasyondan tamamen uzak d\u00fc\u015f\u00fcn\u00fclmelidir.\u00a0 <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">B-1982 ANAYASASINA \u0130T\u0130RAZ EDEN KES\u0130MLER<\/span><\/span><\/b><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">1- Dinlerine uygun bir bi\u00e7imde ya\u015famak istediklerinde a\u011f\u0131r yasal bask\u0131lar ve yasaklarla kar\u015f\u0131la\u015fan dindarlar,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">2- Ulus devletin veya resmi ideolojinin ulusal varl\u0131klar\u0131n\u0131 yok sayarak yasal bask\u0131lara maruz b\u0131rakt\u0131\u011f\u0131 K\u00fcrtler,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">3- Devletin ayr\u0131mc\u0131l\u0131\u011fa dayal\u0131 resmi din politikas\u0131ndan rahats\u0131z olan Aleviler,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">4- Devletin kapitalist yap\u0131s\u0131na vurgu yaparak ekonomik d\u00fczene itiraz eden solcular,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">5- Dinsel az\u0131nl\u0131klar ve cemaatler, <\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">6- Gelir da\u011f\u0131l\u0131m\u0131ndaki adaletsizliklerin do\u011furdu\u011fu varo\u015flarda ya\u015fama m\u00fccadelesi veren kent yoksullar\u0131 veya b\u00fcy\u00fck kentlerde refahtan yeterli oranda pay alamayan ta\u015fral\u0131 kesimler,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">6- Globalle\u015fmenin beraberinde getirdi\u011fi yo\u011fun ve h\u0131zl\u0131 rekabet \u015fartlar\u0131nda b\u00fcrokratik i\u015fleyi\u015fin hantall\u0131\u011f\u0131ndan ve ay\u0131pl\u0131 demokrasiden kaynaklanan siyasi kaos ve istikrars\u0131zl\u0131klar y\u00fcz\u00fcnden ya\u015fanan ekonomik krizlerden kurtulmak isteyen i\u015fadamlar\u0131,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">7- Demokrat ayd\u0131nlar,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">9- \u0130nsan Haklar\u0131 Savunucular\u0131,<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">10- \u00c7evreciler ve hayvan haklar\u0131 savunucular\u0131,\u00a0\u00a0\u00a0 <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">11- Dezavantajl\u0131 sosyal s\u0131n\u0131flard\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">C-YEN\u0130 ANAYASADA OLMASI GEREKEN BAZI HUKUKSAL PERSPEKT\u0130FLER<\/span><\/span><\/b><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>1<\/b>&#8211; Yeni anayasa birey, grup ve s\u0131n\u0131flar\u0131 de\u011fil devleti s\u0131n\u0131rlamal\u0131d\u0131r. Devlet, bireyler, gruplar ve s\u0131n\u0131flar aras\u0131nda hakem rol\u00fcn\u00fc \u00fcstlenmelidir. Devlet, vatanda\u015f\u0131na kar\u015f\u0131 son derece \u015feffaf, ula\u015f\u0131labilir, etkilenebilir, de\u011fi\u015ftirilebilir olmal\u0131d\u0131r.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>2-<\/b> \u00c7ok dinli ve \u00e7ok etnisiteli olan genel toplumun herhangi bir grup kimli\u011fi esas al\u0131narak tan\u0131mlanmamas\u0131 ve b\u00fct\u00fcn kimlikleri anayasal g\u00fcvenceye ba\u011flayan bir vatanda\u015fl\u0131k tan\u0131m\u0131n\u0131n yap\u0131lmas\u0131 gerekir. \u201cAnayasal Vatanda\u015fl\u0131k\u201d farkl\u0131 kimliklerin bir arada ya\u015famas\u0131n\u0131 m\u00fcmk\u00fcn k\u0131lan hukuki bir ba\u011f olarak tan\u0131mlanmal\u0131d\u0131r.\u00a0 Bu anayasal vatanda\u015fl\u0131k tan\u0131m\u0131nda T\u00fcrkl\u00fck gibi herhangi bir ulusal vurgu bulunmamal\u0131d\u0131r. \u00dcst kimlik, farkl\u0131 olanlar taraf\u0131ndan \u201cpayla\u015f\u0131lan kimlik\u201d olarak form\u00fcle edilmelidir.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">1921 Te\u015fkil\u00e2t-\u0131 Esas\u00eeye Kanunu, \u201cT\u00fcrk Devleti\u201dnden de\u011fil, \u201cT\u00fcrkiye Devleti\u201dnden bahsetmektedir (m.3, 10). Keza, Cumhuriyeti il\u00e2n eden 29 Ekim 1923 tarih ve 364 say\u0131l\u0131 Te\u015fkil\u00e2t-\u0131 Esas\u00eeye Kanununu de\u011fi\u015ftiren Kanun da \u201cT\u00fcrkler\u201dden de\u011fil, \u201cT\u00fcrkiye\u201dden bahsetmektedir. Ayn\u0131 \u015fekilde Osmanl\u0131 Saltanat\u0131n\u0131 kald\u0131ran 30 Ekim 1922 tarihli Meclis Karar\u0131nda da \u201cT\u00fcrkiye H\u00fck\u00fbmeti\u201dnden bahsedilmektedir. Dahas\u0131 Hil\u00e2fet ile Saltanat\u0131 birbirinden ay\u0131ran 1-2 Kas\u0131m 1922 tarih ve 308 say\u0131l\u0131 Meclis Karar\u0131nda da \u201cT\u00fcrkiye halk\u0131\u201dndan bahsedilmektedir.<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">Madde Metni: T\u00fcrkiye Cumhuriyeti s\u0131n\u0131rlar\u0131 i\u00e7inde ya\u015fayan herkes T\u00fcrkiye Cumhuriyetinin e\u015fit ve\u00a0 sayg\u0131n vatanda\u015flar\u0131d\u0131r.<\/span><\/span><\/b><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>3-<\/b> Laiklik dini \u00f6zg\u00fcrl\u00fckleri k\u0131s\u0131tlayacak bir yoruma i\u015faret etmemelidir. Laikli\u011fin &#8220;ne olmad\u0131\u011f\u0131&#8221; de\u011fil, ne oldu\u011fu a\u00e7\u0131k\u00e7a belirtilerek tan\u0131mlanmal\u0131d\u0131r. Bu ba\u011flamda, din ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc teminat alt\u0131na ald\u0131\u011f\u0131 ve t\u00fcm inan\u00e7 gruplar\u0131na e\u015fit mesafede oldu\u011fu vurgulanmal\u0131d\u0131r.\u00a0 Ayr\u0131ca, laikli\u011fin tan\u0131m\u0131 sadece inan\u00e7 ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fc temelinde dini \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsamamal\u0131 ayn\u0131 zamanda hukuksal, sosyal ve siyasal \u00f6neri ve tart\u0131\u015fmalarda dini referansl\u0131 tezlerin i\u015flenmesine izin vermelidir. Diyanet i\u015fleri ba\u015fkanl\u0131\u011f\u0131 farkl\u0131 inan\u00e7 sistemlerine a\u00e7\u0131k bir tarzda yap\u0131lanmakla birlikte \u00f6zerk bir hale getirilmelidir.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">Madde Metni: Laiklik din ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn teminat\u0131 olarak yorumlan\u0131r ve devletin t\u00fcm inan\u00e7 gruplar\u0131na e\u015fit mesafede bulunmas\u0131n\u0131 temin eder. T\u00fcm inan\u00e7lar\u0131n korunmas\u0131n\u0131 ve ya\u015fanmas\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131r.<\/span><\/span><\/b><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>4-<\/b> <b>\u00c7ok ulusluluk ve \u00e7ok k\u00fclt\u00fcrl\u00fcl\u00fck ba\u011flam\u0131nda farkl\u0131 olana onay verilmelidir. Farkl\u0131 toplumsall\u0131k k\u00fclt\u00fcrlerini korumak i\u00e7in bireysel ve grupsal haklar \u00e7er\u00e7evesinde \u00f6zy\u00f6netim hakk\u0131, k\u00fclt\u00fcrel haklar, dilsel haklar ve \u00f6zel temsil haklar\u0131 getirilmelidir. Yurtta\u015flar\u0131n kendi anadilleriyle e\u011fitim ve \u00f6\u011fretim haklar\u0131 en me\u015fru haklar\u0131 oldu\u011fu gibi bu dillerin kamusal birimlerde kullan\u0131larak hayata ge\u00e7irilmesini devlet d\u00fczenler. Bu konu devlet g\u00fcvencesi alt\u0131ndad\u0131r.\u00a0 B\u00f6lgelerin idari ve siyasal talepleri g\u00f6z \u00f6n\u00fcnde bulundurularak\u00a0 ya idari veya hem idari hem siyasi adem-i merkeziyet\u00e7i bir sistem tesis edilmelidir. Bu yolla devletin merkeziyet\u00e7i-b\u00fcrokratik ve siyasi egemenli\u011fi merkezin tekeline alan hegemonik yap\u0131s\u0131 de\u011fi\u015ftirilmelidir.<\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: Times New Roman; font-size: medium;\">Bu ba\u011flamda, 1921 Anayasas\u0131n\u0131n 11.maddesi g\u00f6z\u00f6n\u00fcnde bulundurularak yeni bir metin olu\u015fturulmal\u0131d\u0131r.&#8221; : \u201c Vil\u00e2yet mahalli umurda manevi \u015fahsiyeti ve muhtariyeti haizdir. Harici ve dahili siyaset, \u015fer\u2019i adl\u00ee ve askeri umur, beynelmilel iktisad\u00ee m\u00fcnasebat ve h\u00fck\u00fbmetin umumi tek\u00e2lifi ile menafii birden ziyade vil\u00e2yata, \u015f\u00e2mil hususat m\u00fcstesna olmak \u00fczere B\u00fcy\u00fck Millet Meclisince vaz edilecek kavanin mucibince evkaf, Medaris, Maarif, S\u0131hhiye, \u0130ktisat, Ziraat, Nafia ve Muaveneti i\u00e7timaiye i\u015flerinin tanzim ve idaresi vil\u00e2yet \u015f\u00fbralar\u0131n\u0131n sal\u00e2hiyeti dahilindedir.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>5<\/b>&#8211; Sivil siyaset ve g\u00fcvenlik b\u00fcrokrasisi ili\u015fkisi 1776 Virginia \u0130nsan Haklar\u0131 Beyannamesinde de yer ald\u0131\u011f\u0131 gibi, \u201cher hal\u00fckarda askeri kuvvet, kesin surette sivil idareye tabi olacakt\u0131r\u201d \u015feklinde d\u00fczenlenmelidir. Bu ba\u011flamda Genel Kurmay Ba\u015fkanl\u0131\u011f\u0131 Milli Savunma Bakanl\u0131\u011f\u0131na ba\u011flanmal\u0131, Jandarma Genel Komutanl\u0131\u011f\u0131 da \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131na ba\u011flanarak &#8220;k\u0131r polisi&#8221;ne d\u00f6n\u00fc\u015ft\u00fcr\u00fclmelidir.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">Madde Metni: Genelkurmay Ba\u015fkanl\u0131\u011f\u0131 Milli Savunma Bakanl\u0131\u011f\u0131na ba\u011fl\u0131d\u0131r. TSK. b\u00fcnyesindeki Jandarma Genel Komutanl\u0131\u011f\u0131 da \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 olup, bu te\u015fkilat &#8220;k\u0131r polisi &#8221; olarak k\u0131rsal alanda g\u00fcvenli\u011fi temin eder.<\/span><\/span><\/b><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\"><b>6-<\/b> Demokrasi sadece farkl\u0131 siyasal e\u011filimlerin \u00f6rg\u00fctlenebildi\u011fi bir sistem olarak de\u011fil ayn\u0131 zamanda yarg\u0131sal sistem \u00e7e\u015fitlili\u011fine izin veren bir sistem \u015feklinde yorumlanmal\u0131d\u0131r. Bu ba\u011flamda, kamu hukukunda ortak olunmakla birlikte, fark\u0131 inan\u00e7 gruplar\u0131n\u0131n \u00f6zel hukukta kendi tabi olacaklar\u0131 hukuku se\u00e7melerine imkan tan\u0131nmal\u0131d\u0131r. Birden fazla taraf\u0131 olan ihtilaflarda, ma\u011fdurun tabi oldu\u011fu hukuk esas al\u0131nmal\u0131d\u0131r. Yarg\u0131n\u0131n idari yap\u0131lanmas\u0131 da tarafs\u0131zl\u0131k ve e\u015fitlik ilkesini g\u00f6lgeleyecek t\u00fcm ba\u011f\u0131ml\u0131 mekanizmalardan uzak tutularak kurgulanmal\u0131d\u0131r.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><b><span style=\"font-size: medium;\"><span style=\"font-family: Times New Roman;\">Madde Metni: Yarg\u0131 tarafs\u0131z ve ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 g\u00fcvence alt\u0131ndad\u0131r.
